BREAKING! San Francisco judge (go figure) just ruled President Trump’s defunding of sanctuary cities unconstitutional
It is time for the Supreme Court to get involved in this border security mess. President Trump very much wants border security for American citizens and is doing all he can to provide it. However, the liberal waste products in California and the sad jokes who pass for judges in the 9th Circuit Court are determined that they are going to run America, the Constitution be damned!
I would like for Judge Orrick to provide the exact language in our Constitution that permits cities within the United States to violate federal law.
President Trump’s executive order attempting to punish sanctuary cities is illegal, a federal judge ruled Tuesday, according to The Washington Times — but the government can still use existing laws to strip some federal money from jurisdictions that refuse to comply with existing laws requiring them to cooperate with law enforcement.
It’s the latest legal spanking for Mr. Trump, who has seen the federal courts halt his extreme vetting policy as well.
In the case of the sanctuary city order, the president had directed his attorney general and homeland security secretary to look at ways to leverage billions of dollars in federal grants to force states, cities and counties to cancel policies that thwarted cooperation with federal immigration agents.
The policy hasn’t gone into effect but San Francisco and Santa Clara counties sued, arguing they feared losing money. Judge William H. Orrick, sitting in San Francisco, sided with the two counties — and said his injunction applies to the entire country.
“The counties have a strong interest in avoiding unconstitutional federal enforcement and the significant budget uncertainty that has resulted from the order’s broad and threatening language,” Judge Orrick wrote.
He said Mr. Trump overstepped his bounds by going beyond the laws written by Congress. But he said any existing laws that require cooperation in exchange for federal funding can still be enforced.
That means sanctuary cities can lose money from several Justice Department programs that already require certification of cooperation.
Those programs are the Byrne Justice Assistance Grants, the COPS program and the State Criminal Alien Assistance Program, which pays local prisons and jails to hold illegal immigrants.
