There are few people who know the Constitution as well as Mark Levin.

One of those constitutional scholars would be Steven Calabresi, a law professor at Northwestern University (also co-founder of The Federalist Society), who has discovered an egregious violation of our Constitution that has been right under our noses since shifty, shady Rosenstein appointed Robert Mueller, making his subordinates not only a team of special prosecutors but also acting Assistant US Attorneys, making their supervisor, Mueller, an acting US Attorney, an appointment which is reserved for one person, the President of the United States.

Citing Calabresi as the discoverer of Rosenstein’s not-so-obscure violation, Levin pointed out that the appointments of Mueller’s subordinates as “Special Assistant US Attorneys” nullified the investigation, as only a US Attorney can make those appointments, making Mueller a de facto US Attorney, whose appointment is reserved for the president.

That Rosenstein and Mueller would usurp the authority of the man they are trying to destroy is only the latest unethical, illegal, immoral act by the deep state swamp rats who have illegally granted themselves the authority to destroy a sitting president, nothing less than seditious conspiracy, as I read 18 US Code § 2384.

Constitutional expert and “Life, Liberty & Levin” host Mark Levin said on “Hannity” that new revelations about Robert Mueller’s investigation into President Donald Trump and alleged Russian collusion appear to render the probe unconstitutional.

Levin said a new “special status” given to several of Mueller’s prosecutors in the arm of the probe involving former Trump campaign chief Paul Manafort may be key to invalidating the entire investigation.

The nation is sick to tears of this farce of an investigation. It is very clear to any objective observer that there is no evidence, there has been no evidence, of any wrongdoing on the part of President Trump or his subordinates.

However, there is a mountain of not only evidence, but PROOF, and it is public, that all of the deep state actors in this tragic bit of treasonous, absurd theater are guilty as hell of conspiring to destroy a sitting US president, clearly seditious conspiracy, and they should all pay the prescribed price for it, 20 years in a nice, warm, tropical locale – Gitmo!

Levin said the attorneys in the case before an Alexandria, Va. federal judge are simultaneously considered “Special Assistant U.S. Attorneys.”

He said that therefore, their direct supervisor — Mueller — should be lawfully considered a “roving” U.S. Attorney.

He said the Constitution designates the president as the person who must nominate all “principal officers” — including U.S. attorneys and cabinet members.

But, Mueller was appointed by Deputy Attorney General Rod Rosenstein and was not confirmed by the Senate, as anyone working as a U.S. attorney should be by law, according to Levin.

Levin said that the scenario therefore “violates the Constitution [via] the Appointments Clause” in Article II.

“Rosenstein usurped the authority of the president of the United States to nominate whoever he wants as a prosecutor,” Levin said.

Jeff Sessions allowed Rosenstein to run rogue with the Mueller appointment, he himself abandoning the president for “conflict of interest” reasons that appear completely bogus to me. Recusing himself did not mean that he was bound to allow Rosenstein to violate the Constitution.

Sessions should have been fired long ago, but certainly President Trump now has all the justification he needs to send Sessions back to Alabama.  For nearly a year and a half Sessions has sat idly by, watching as his subordinates conspired to destroy his boss.

Unforgivable! President Trump and the American people deserve far better than Jeff Sessions.

Levin called on every defendant in the Mueller probe and all attorneys for those subpoenaed or affected to raise the issue of the Appointments Clause in court.

“The breadth of his investigation is so massive, so broad [that] four of his own people get dual appointments [as assistant U.S. attorneys],” he added.
